CTA UPDATE: Supreme Court Reinstates Reporting Requirements Under Corporate Transparency Act

On January 23, 2025, the United States Supreme Court granted the government’s request for a stay of the injunction against enforcement of the CTA and the BOI filing requirements pending the disposition of the appeal pending with Fifth Circuit Court of Appeals. That appeal, which is only an appeal of the lower court’s nationwide injunction against enforcement pending the resolution of the actual case (Texas Top Cop Shop, Inc. v. Garland) is scheduled to be heard in late March.

The Supreme Court reinstatement of the government’s authority to require reporting and its enforcement is effective immediately. Previously when the government’s authority was reinstated, FINCEN announced an extended due date for filing (January 13). FINCEN has not yet announced what, if any, extensions will be granted, so filing should begin immediately.
